- Primero. REVOCAR el fallo proferido el cinco (5) de diciembre de dos mil dos (2002), por el Juzgado 45 Civil Municipal de Bogota, dentro de la accion de tutela instaurada por el senor Hector Jacinto Parada Torres contra el Hospital Simon Bolivar de Bogota y la Secretaria de Salud Distrital de Bogota. En su lugar, se CONCEDE el amparo solicitado por el actor, por las razones expuestas en la parte motiva de esta sentencia.
- Segundo. ORDENAR a la Secretaria de Salud Distrital de Bogota, dentro del termino de cuarenta y ocho (48) horas, siguientes a la notificacion de esta sentencia, efectue un nuevo estudio de las condiciones socioeconomicas del actor, teniendo en cuenta la enfermedad que padece.
- Asi mismo, el Hospital Simon Bolivar de Bogota debe continuar prestando el servicio medico especializado y suministrando los medicamentos que el actor enfermo de sida requiere.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
