- Primero. REVOCAR la sentencia proferida en segunda instancia por el Juzgado Promiscuo del Circuito de Segovia. En su lugar, NEGAR la tutela, con base en las consideraciones aquí expuestas.
- Segundo. No obstante negarse la tutela, se advierte que si durante el trámite surtido por esta acción de tutela, el Municipio de Segovia hubiere dado cumplimiento a lo ordenado en la sentencia de segunda instancia, se habrá configurado un pago de lo debido, y por ello, no se podrá exigir a la actora el reembolso de los dineros por ella recibidos como pago del contrato de suministro suscrito.
- Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
