- Primero. REVOCAR, por las razones consignadas en esta providencia, los fallos proferidos por EL JUZGADO
- SEGUNDO. PROMISCUO MUNICIPAL DE SABANALARGA DEPARTAMENTO DEL ATLANTICO, de fecha 3 de marzo de 2000, despacho que conoció en primera instancia de la acción de tutela de la referencia, a través del cual negó dicha acción, y por la SALA CIVIL CIVIL-FAMILIA DEL TRIBUNAL SUPERIOR DE BARRANQUILLA, de fecha 5 de mayo de 2000, que confirmó esa decisión.
- Segundo. CONCEDER la tutela interpuesta por el señor JESUS DE LOS REYES SARMIENTO en nombre y representación de su menor hija RUTH MARIA DE LOS REYES V., para proteger sus derechos fundamentales a la igualdad y a la educación; al efecto ordenarle a la Secretaría de Educación del Departamento del Atlántico y a la rectora del COLEGIO DE BACHILLERATO FEMENINO DE SABANALARGA (ATLANTICO), adoptar las medidas pertinentes que garanticen el acceso y permanencia de la actora en el sistema educativo oficial, en ese u otro establecimiento educativo de carácter oficial.
- Tercero. REQUERIR a la Secretaría de Educación del Departamento del Atlántico, para que proceda al cumplimiento de esta Sentencia y garantice la realización efectiva de los derechos a la igualdad y a al educación de la peticionaria.
- Cuarto. Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
