- Primero. CONFIRMAR el fallo proferido por el Juzgado
- Cuarto. Penal del Circuito de Cartagena, el siete (7) de marzo de 2000, que negó la tutela interpuesta por la señora Loresna Raquel Sierra Robles.
- Segundo. REVOCAR el fallo proferido por la Sala de Casación Civil y Agraria de la Corte Suprema de Justicia, el cuatro (4) de abril de 2000. En su lugar CONCEDER la acción de tutela interpuesta por María Magdalena Jaramillo Chaverra contra el Seguro Social.
- Tercero. ORDENAR a la E.P.S. del Seguro Social, Seccional Antioquia, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a pagar la licencia de maternidad a la señora María Magdalena Chaverra Jaramillo.
- Cuarto. Por Secretaría. líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
