- R E S U E L V E
- Primero. REVOCAR en todas sus partes la sentencia del seis (6) de diciembre de 1992, proferida por el Juzgado 61 Penal del Circuito de Santafé de Bogotá, que denegó la tutela solicitada por el señor Francisco José Cepeda, en cuanto desconoció el derecho fundamental de petición consagrado en el artículo 23 de la Constitución Política.
- Segundo. ORDENAR al director de la Cárcel Nacional Modelo para que en el término de cuarenta y ocho (48) horas contadas a partir de la fecha de notificación de esta providencia, se sirva certificar si, en efecto, el señor Francisco José Cepeda trabajó durante los días domingos y festivos en el señalado establecimiento carcelario.
- Tercero. LIBRESE, por intermedio de la Secretaría de la Corporación, la comunicación correspondiente al Juzgado 61 Penal del Circuito de Santafé de Bogotá, con el fin de que se le de aplicación a lo previsto en el artículo 36 del decreto 2591 de 1991.
