Primero. CONFIRMAR la sentencia proferida por el Juzgado Cincuenta y Dos Penal del Circuito de Bogotá, el veinticinco (25) de junio de dos mil uno (2001), respectivamente, mediante la cual DENEGÓ la tutela instaurada por la señora Rosa María Bautista Vergara contra el Fondo Nacional del Magisterio de Bogotá D.C. y la Fiduciaria la Previsora S.A, pero por las razones expuestas en esta providencia.
Segundo. PREVENIR a los demandados para que no vuelvan a incurrir en los hechos que dieron origen a esta tutela.
Tercero. Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
