- Primero. REVOCAR la sentencias proferidas el 21 de julio de 2003 por la Sala Penal del Tribunal Superior de Bogotá y el 27 de agosto del mismo año por la Sala de Casación Penal de la Corte Suprema de Justicia, por medio de las cuales fue declarada improcedente la acción de tutela instaurada por el señor Ancizar Rivera Munar, para en su lugar y declarando procedente a la misma, DENEGAR el amparo pretendido.
- Segundo. Por Secretaría, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
