- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E:
- PRIMERO. Revocar la sentencia de fecha 26 de Julio de 1994, proferida por el Tribunal Administrativo del Magdalena, mediante la cual se concedió la tutela impetrada por la sociedad actora y se declaró la cesación de los efectos del fallo de tutela proferido por la Sala Penal del Tribunal Superior del Distrito Judicial de Santa Marta el 25 de agosto de 1993, en favor de los señores Carlos Jiménez Mier y otros. En su lugar niégase la tutela solicitada.
- SEGUNDO. Disponer que por Secretaría General se comunique el contendio de esta providencia al Juzgado 6o. Penal del circuito de Santa Marta para los fines previstos en el artículo 36 del Decreto 2591 de 1991.
