- Primero. REVOCAR el fallo proferido el 16 de septiembre de 1994 por el Tribunal Superior del Distrito Judicial de Cartagena -Sala Civil de Decisión-, mediante el cual se resolvió negar el amparo solicitado por JOSE ELJACH GALVIS.
- Segundo. CONCEDER la tutela impetrada y, en consecuencia, ORDENAR a la Iglesia "CENTRO CRISTIANO NUEVA JERUSALEN", representada por YONNY COPETE GARZON, domiciliado en el barrio la Consolata, manzana H, lote 20, del Distrito de Cartagena, que en el ejercicio de su culto se abstenga de ocasionar injerencias por ruido que vulneren los derechos fundamentales del accionante. Para el efecto, utilizará los altoparlantes y demás medios técnicos de amplificación del sonido únicamente en la medida necesaria para la práctica del culto y, cuando sea indispensable acudir a ellos, los operará a niveles bajos de volúmen.
- Tercero. REMITASE al Alcalde Municipal del Distrito de Cartagena, copia de la presente providencia, para que adelante las actividades de policía administrativa conducentes a controlar las emisiones de ruido, relacionadas con el ejercicio de la libertad de cultos por parte de la iglesia "CENTRO CRISTIANO NUEVA JERUSALEN"
- Cuarto. Se confía al Tribunal Superior del Distrito Judicial de Cartagena -Sala Civil de Decisión-, la responsabilidad de vigilar el estricto cumplimiento de esta providencia.
- Quinto. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
