- R E S U E L V E :
- Primero. REVOCAR la sentencia de fecha 15 de agosto de 1995, proferida por la Sala Laboral del Tribunal de Santa Fe de Bogotá, con base en las consideraciones expuestas.
- Segundo. CONCEDER la tutela impetrada y en consecuencia, tutelar los derechos a la igualdad y al trabajo del señor José Norberto Patiño Pinto.
- Tercero. ORDENAR al representante legal de la empresa Colombian Sewing Machine Company S.A. que proceda a efectuar los ajustes salariales para que los empleados sindicalizados obtengan los mismos beneficios que ostentan quienes no están sindicalizados y realizan la misma labor, de acuerdo con las razones expuestas.
- Cuarto. El Tribunal Superior -Sala Laboral- del Distrito Judicial de Santa Fe de Bogotá, vigilará el estricto cumplimiento de lo ordenado en esta sentencia.
- Quinto. Líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
