- Primero. Decláranse EXEQUIBLES la ley 5ª de 1979 y el decreto 100 de 1980, "Por medio del cual se expide el Código Penal", por no desconocer el artículo 150, numeral 10º de la Constitución.
- Segundo. ESTÉSE a lo resuelto en la sentencia de la Corte Suprema de Justicia del nueve (9) de abril de mil novecientos ochenta (1980), que declaró exequibles la ley 5ª de 1979 y el decreto 100 de 1980, por no contrariar el artículo 76, numeral 12, de la Constitución de 1886.
