PRIMERO. Decláranse EXEQUIBLES los literales f) del artículo 27, en su totalidad, y b) del artículo 38 de la ley 31 de 1992, en el aparte que dice "en los Estatutos del Banco", con la advertencia de que las normas contenidas en los Estatutos no podrán vulnerar los beneficios establecidos en leyes laborales.
SEGUNDO. Declárase EXEQUIBLE el texto del inciso
segundo. del artículo 39 de la misma ley, que dice: "Para los fines del artículo 56 de la Constitución Política, defínese como servicio público esencial la actividad de banca central". La exequibilidad de este inciso, que aquí se declara, se limita expresamente a los motivos aducidos en esta sentencia, y concretamente al examen a la luz del artículo 56 de la Constitución.
TERCERO. Declárase EXEQUIBLE la expresión "y trabajadores" del inciso
primero. del artículo 39 de la ley 31 de 1992, en cuanto la calificación de empleados de confianza recaiga en los funcionarios públicos del Banco de la República, y en los trabajadores que, de conformidad con la ley, el reglamento interno de trabajo, la convención colectiva y los contratos de trabajo, tengan una responsabilidad directiva, o cuyos servicios supongan un alto grado de identificación con el Banco.
