- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E
- Primero. Declarar INEXEQUIBLE la expresion "siempre que ambos hubieren permanecido solteros durante el concubinato", contenida en el articulo 55 de la Ley 90 de 1946.
- Segundo. Las personas que, con posterioridad al siete de julio de 1991 no hubieren podido sustituirse en la pension del fallecido, por causa de la aplicacion del texto legal que ha sido declarado inconstitucional, podran, a fin de que se vean restablecidos sus derechos constitucionales conculcados, reclamar de las autoridades competentes el reconocimiento de su derecho a la sustitucion pensional.
