Revisión de constitucionalidad del Decreto Legislativo 817 de 2020, por el cual se establecen las condiciones especiales para la emisión de valores en el segundo mercado por parte de empresas afectadas en el marco del Estado de Emergencia Económica, Social y Ecológica declarado por el Decreto 637 del 6 de mayo de 2020.
La norma objeto de estudio tiene como propósito permitir el ingreso de las Sociedades por Acciones Simplificadas (SAS) en el mercado de valores.
La Corte determinó que dicha disposición cumple los requisitos formales y materiales de validez definidos por la Constitución, la Ley Estatutaria 137 de 1994 y la jurisprudencia constitucional y, en tal sentido, declaró su EXEQUIBILIDAD.
