  1. Primero. Declarar EXEQUIBLES los articulos 30, 31, 37 y 38, primera parte, de la ley 142 de 1994, demandados en su totalidad por el actor.
  2. Segundo. Declarar EXEQUIBLE la expresion "ajena a intereses partidistas" del numeral 3deg del articulo 27 de la misma ley.
  3. Tercero. Declarar EXEQUIBLE la frase "En estos casos, y en los de otros contratos de las empresas, las comisiones de regulacion podran exigir, por via general, que se celebren previa licitacion publica, o por medio de otros procedimientos que estimulen la concurrencia de oferentes" del articulo 35 acusado. Asi mismo, la frase "Salvo los contratos de que trata el numeral 39.1, todos aquellos a los que se refiere este articulo se regiran por el derecho privado" del paragrafo del articulo 39 de la ley 142 de 1994.
  4. Cuarto. Declarar EXEQUIBLES el numeral 7deg del articulo 27; y los incisos
  5. primero. y
  6. segundo. del articulo 32, todos de la citada ley.
  7. Quinto. INHIBIRSE de fallar a proposito de la segunda parte del articulo 38 de la ley objeto de control.
