Revisión de constitucionalidad del Decreto Legislativo N.º 1874 de 1992, “"Por el cual se dictan normas sobre destinación de bienes y embargo preventivo, en materia de delitos de competencia de jueces regionales".
La Corte concluyó que las consecuencias atribuidas por las normas sub-examine a ese abandono que de sus derechos hace el titular, sea él o no sea autor o copartícipe de los delitos que dieron lugar a la apertura del proceso, es perfectamente compatible con la protección constitucional de la propiedad y los demás derechos adquiridos, por cuanto ella exige el cumplimiento de obligaciones mínimas que se deducen de la función social, según lo manda el artículo 58 de la Constitución.
Por tanto, la Corte declaró constitucional el decreto legislativo objeto de revisión.
