- Primero. ESTESE a lo resuelto en la sentencia C-494 de 1996, en relación con la expresión "así medie renuncia previa de su empleo" del numeral 7o. del artículo 5o. de la ley 177 de 1994, la cual fue declarada inexequible por el referido fallo.
- Segundo. Declárase EXEQUIBLE la expresión "durante el período para el cual fue elegido y durante el año siguiente al mismo", del numeral 7o. del artículo 5o. de la ley 177 de 1994, por las razones expuestas en la parte motiva de este fallo.
