Se confirmó el auto suplicado del 14 de septiembre de 2001, por el cual se rechazó la demanda de inconstitucionalidad interpuesta por el ciudadano de la referencia contra los artículos 42 y 43 de la Ley 99 de 1993.
La Corte explicó que los artículos acusados, fueron objeto de un amplio y extenso examen, para luego concluir que los mismos no quebrantan la Constitución Política, por lo cual entonces en el presente caso, no se puede predicar que se está ante una cosa juzgada meramente aparente como lo afirma el accionante, sino por el contrario se está frente a una cosa juzgada constitucional.
