Se abstuvo por carencia absoluta de objeto de emitir pronunciamiento alguno en el presente expediente, toda vez que si el desistimiento por parte del accionante se presenta antes de que dicte sentencia de primera instancia y el mismo es jurídicamente admisible, no existe camino distinto al de archivar el expediente, tal y como la misma norma lo ordena claramente.
En consecuencia, se ordena la devolución inmediata del expediente al Juzgado de origen.
