La Corte realiza reiteración de jurisprudencia sobre la nulidad de las sentencias proferidas por esta corporación y el alcance de la causal de nulidad de desconocimiento de jurisprudencia, se concluye que si existió vulneración al debido proceso, ya que se desconoció la jurisprudencia de esta corporación, y por lo tanto se decide declarar la nulidad de la sentencia

- Primero. DECLARAR la nulidad de la sentencia T-168 de 2009 proferida por la Sala Octava de Revision. En consecuencia, debera ser adoptada una nueva providencia por la Sala Plena, que reemplace a la anterior.
- Segundo. ORDENAR que por Secretaria General de la Corte se solicite al Juzgado
- Segundo. Penal para Adolescentes con Funcion de Conocimiento de Pereira remitir al Despacho, dentro de los ocho (8) dias siguientes al recibo de la comunicacion, el expediente T-2.021.850.
