Primero. REVOCAR el fallo proferido por la Sala Laboral del Tribunal Superior de Cali, el cual negó el amparo solicitado por la accionante.
Segundo. CONCEDER la tutela de los derechos fundamentales invocados por la demandante. En consecuencia, ORDENAR a la empresa COOMEVA, seccional Cali, inaplicar el artículo 63 del Decreto 806 de 1998, para que dentro del improrrogable término de 48 horas siguientes a la notificación del presente fallo, proceda a reconocer y pagar la licencia de maternidad a la actora. En caso de que esta entidad lo considere pertinente, podrá solicitar al Fondo de Solidaridad y garantía, el reembolso de la suma pagada.
Tercero. Por Secretaria, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
