Primero. REVOCAR la sentencia de 14 de marzo del año en curso, dictada por el Juzgado
Cuarto. Civil del Circuito de Cúcuta, Norte de Santander.
Segundo. CONCEDER la tutela del derecho fundamental a la dignidad humana al señor EDINSON AMAYA LINCE, vulnerado por el Comando del Departamento de Policía de Norte de Santander.
Tercero. ORDENAR, en consecuencia, al Comandante del Departamento de Policía de Norte de Santander que, dentro del perentorio término de cuarenta y ocho (48) horas a partir de notificación personal de esta providencia, en el evento de que el señor AMAYA LINCE se encuentre aún recluido en el Hospital Erasmo Meoz de Cúcuta, si es que aún no lo ha hecho, ordene que el mencionado ciudadano sea despojado de las esposas que le fueron colocadas, y designe, si ello es necesario, un agente de la institución para que lo vigile y custodie hasta cuando éste pueda ser remitido a la cárcel del lugar, o cesen los motivos de la vigilancia que se le solicitó por la Fiscalía Sexta Delegada.
Cuarto. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
