  1. Primero. CONFIRMAR la sentencia de tutela proferida por el Juzgado
  2. Tercero. Civil Municipal de Cúcuta, con base en las consideraciones aquí expuestas.
  3. Segundo. Sin embargo, MODIFICAR la orden impartida por el juez de instancia, y en su lugar, ordenar al señor Alcalde Municipal de Cúcuta, que el término de cuarenta y ocho (48) horas siguientes a la notificación de ésta providencia, cancele las mesadas adeudadas a la demandante, siempre y cuando exista partida presupuestal disponible. En caso de que no exista la respectiva partida, deberá realizar las operaciones presupuestales para garantizar el pago de las mesadas adeudadas. Dichas gestiones no podrán exceder el término perentorio de tres (3) meses.
  4. Tercero. PREVENIR a la entidad demandada para que cumpla lo dispuesto en éste fallo, so pena de incurrir en desacato, y para que en lo sucesivo no repita la omisión que dio origen a la presente acción.
  5. Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
