Primero. REVOCAR las sentencias proferidas por el Juzgado Veintiséis Penal Municipal de Santiago de Cali el 6 de abril de 1999, y por el Juzgado
Noveno. Penal del Circuito el 11 de mayo de 1999, mediante los cuales se negó la protección judicial invocada y, en su lugar, CONCEDER al señor JAIME FRANCO CARDONA la protección constitucional a su condición de discapacitado visual.
Segundo. ORDENAR a la Secretaría del Deporte y la Recreación de la Alcaldía del municipio de Santiago de Cali adoptar las medidas pertinentes en orden a hacer efectiva la protección constitucional a la condición de discapacitado visual del accionante, ora, siendo tenido en cuenta por Megaservicios para prestar el servicio de aseo de las baterías sanitarias del Estadio Pascual Guerrero, o de cualquier otra forma que le permita obtener, así sea de manera parcial, el ingreso que requiere para su subsistencia.
Tercero. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
