Primero. CONFIRMAR los fallos proferidos por la Sala Casacion Laboral de la Corte Suprema de Justicia (exp. T-218363) y por la Seccion Cuarta de la Sala Contencioso Administrativa del Consejo de Estado (exp. 233722), pero por las motivaciones aqui expuestas.
Segundo. Para el cumplimiento de lo dispuesto en el numeral anterior se ordena que por Secretaria General, se devuelvan los expedientes a los jueces de instancia.
