- Primero. CONFIRMAR la decisión proferida por el 16 de marzo de 2001 por el Juzgado Civil del Circuito de Montería en cuanto absolvió de toda responsabilidad a la empresa promotora de salud, Caprecom, E. P. S. Seccional Montería.
- Segundo. SE ADICIONA el fallo de segunda instancia, en el sentido de reconvenir al Municipio de Montería, para que asuma directamente la atención en salud que requiera el señor JESÚS MARIA ORTEGA FABRA, o proceda a su afiliación en caso de que actualmente los pensionados de dicho Municipio no se encuentren afiliados a ninguna entidad prestadora de servicios de salud.
- Tercero. REMITASE, copia de la presente sentencia a la Fiscalía General de la Nación, para lo de su competencia.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
