- Primero. REVOCAR el fallo proferido el 23 de noviembre de mil novecientos noventa y nueve (1999) por la Sala de Casación Laboral de la Corte Suprema de Justicia.
- Segundo. TUTELAR los derechos constitucionales fundamentales de Rosa Elena García Salas y en consecuencia ORDENAR al Director de la Caja de Previsión Social, CAJANAL, que si todavía no lo ha hecho, en el término de quince (15) días contados a partir de la notificación de la presente providencia, proceda a cancelar todas mesadas que adeuda a la accionante.
- Se le previene igualmente, a fin de que realice las gestiones necesarias y adopte los mecanismos legales pertinentes para no continuar incurriendo en omisiones como las aquí probadas, en las cuales la entidad demandada es reincidente, y que ponen en riesgo los derechos fundamentales de la demandante.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
