PRIMERO. REVOCAR la sentencia proferida por el Juzgado Diecisite Civil Municipal de Medellín el 23 de octubre de 2000 y en consecuencia CONCEDER la tutela del derecho a la salud en conexidad con la vida del menor Daniel Raigoza Naranjo.
SEGUNDO. INAPLICAR, para el caso concreto que fue objeto de análisis por esta Sala, el literal f. del artículo 18 de la Resolución 5261 de 1994, expedida por el Ministerio de Salud por contrariar los artículos 13 y 44 de la Constitución Política.
TERCERO. ORDENAR a Susalud E.P.S. que en el término de 48 horas después de notificada esta sentencia remita al menor al médico tratante para que este establezca el tratamiento que debe darse y consecutivamente se aplique lo determinado por el galeno.
CUARTO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
