- Primero. REVOCAR la sentencia de la Sala de Casacion Civil y Agraria de la Corte Suprema de Justicia, de fecha 15 de abril de 1996.
- Segundo. CONFIRMAR la sentencia del Tribunal Superior del Distrito Judicial de Santafe de Bogota D.C. -Sala de Familia, de fecha 5 de marzo de 1996 con la modificacion de que la tutela se concede, como mecanismo transitorio para evitar un perjuicio irremediable.
- Tercero. Los efectos de esta sentencia estaran vigentes, hasta tanto el juez competente no decida sobre la accion que podra promover la Caja de Credito Agrario Industrial y Minero, con el fin de determinar que el demandante no tiene derecho a obtener la devolucion de los dineros depositados en su cuenta de ahorros, junto con los correspondientes rendimientos.
- Cuarto. Por Secretaria General, REMITANSE el expediente de tutela y este fallo a la Sala de Familia del Tribunal Superior de Santafe de Bogota para los efectos consagrados en el articulo 36 del decreto 2591 de 1991.
