- Primero. REVOCAR las sentencias proferidas por el Juzgado Diecisiete Civil Municipal de Barranquilla, el 9 de noviembre de 2000 y, en su lugar, CONCEDER las tutelas a Ramón Abello Galicia y Ulises González, para la protección de sus derechos fundamentales a la seguridad social y a la salud, en consecuencia, ordenar a la EPS Cafesalud atender a los solicitantes y a sus beneficiarios si presentan algún percance o afección en su salud de carácter urgente o de especial gravedad.
- Segundo. ORDENAR a quien ejerza las funciones de liquidador de la Compañía de Inversiones de la Flota Mercante S.A. y al Superintendente de Sociedades, que una vez se den los presupuestos señalados por el liquidador para la obtención de recursos, cancele con cargo a los gastos de administración las sumas adeudadas a la EPS Cafesalud, sin perjuicio de que dicha entidad pueda repetir contra el Fondo de Solidaridad, o hacerse parte en el proceso liquidatorio de la Compañía de Inversiones de la Flota Mercante S.A..
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
