- PRIMERO. Por las razones expuestas en la parte resolutiva de la presente sentencia CONFIRMAR la providencia del Tribunal Superior de Cucuta del 28 de abril de 1992, en el proceso de tutela promovido por Jorge Alexander Moreno Delgado.
- SEGUNDO. ORDENAR que el Comandante de la Quinta Brigada del Ejercito Nacional con sede en Bucaramanga, disponga en el plazo de 48 horas todo lo concerniente al traslado y reclusion del peticionario en el Hospital Militar de Santafe de Bogota, a fin de que reciba la atencion medica que su salud requiere, en condiciones dignas y por todo el tiempo necesario.
- TERCERO. ORDENAR a la Quinta Brigada del Ejercito Nacional que le expida la tarjeta militar al peticionario sin costo alguno.
- CUARTO. En todos aquellos casos similares al presente por sus hechos o circunstancias, siempre que la salud de un soldado se haya visto afectada por accion u omision del Estado, la doctrina constitucional enunciada en esta sentencia tendra CARACTER OBLIGATORIO para las autoridades, en los terminos del articulo 23 del Decreto 2067 de 1991.
- QUINTO. ORDENAR que por Secretaria se comunique esta providencia al Tribunal Superior de Cucuta, el cual debera velar por su oportuno cumplimiento, lo mismo que al Comando General del Ejercito Nacional, a la Quinta Brigada y al "Batallon de Apoyo y Servicio para el Combate" No. 5 "Mercedes Abrego", en la forma y para los efectos previstos en el articulo 36 del Decreto 2591 de 1991.
