- en nombre del pueblo y por mandato de la Constitucion Politica,
- R E S U E L V E :
- Primero. REVOCASE la sentencia de fecha 1 de julio de 1994, proferida por el Tribunal Superior del Distrito Judicial -Sala Civil Laboral- de Villavicencio, conforme a lo expuesto en la parte motiva de esta providencia.
- Segundo. DENIEGASE la solicitud de tutela presentada por el senor Ernesto Prieto Garcia y en consecuencia queda sin efecto la actuacion que haya realizado la Alcaldia Municipal de Arauca, en cumplimiento del fallo de segunda instancia revocado.
- Tercero. COMUNICAR el contenido de esta decision al Juzgado Laboral del Circuito de Arauca, el cual notificara la sentencia de esta Corte a las partes y adoptara las decisiones necesarias para adecuar su fallo a lo dispuesto por esta, de conformidad con el articulo 36 del decreto 2591 de 1991.
