R E S U E L V E
PRIMERO. REVOCAR la sentencia del 5 de mayo de 1992, proferida por el Juzgado 36 de Instrucción Criminal de Ibagué, que denegó la tutela solicitada por el señor RICARDO RIVERA.
SEGUNDO. ORDENAR al Juez 36 de Instrucción Criminal de Ibagué, que, de conformidad con lo dispuesto en el fundamento jurídico número 7 de esta sentencia, determine si RICARDO RIVERA tiene el carácter de indigente absoluto y resulta procedente en su caso que reciba por parte de la autoridad pública respectiva la protección especial contemplada en el inciso 3o. del artículo 13 de la Constitución Política.
TERCERO. LIBRESE comunicación al Juzgado 36 de Instrucción Criminal de Ibagué, con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
