- PRIMERO. REVOCAR la sentencia de tutela proferida por el Juzgado Promiscuo Municipal de Novita Choco el 12 de junio de 1995, y en su lugar, CONCEDER como mecanismo transitorio por el termino de cuatro meses, mientras se inician las acciones administrativas correspondientes, la tutela de los derechos de los ninos y el derecho a la educacion de los alumnos y derecho a la vida de los alumnos y profesores del Colegio Departamental "Carlos Holguin Mallarino" de Novita, segun accion de tutela ejercida por el senor Rafael Ibarguen Asprilla, rector del citado plantel educativo.
- SEGUNDO. Ordenar al Alcalde Municipal de Novita Choco que en el termino de cinco (5) dias inicie los trabajos necesarios para reparar la planta fisica del Colegio Departamental "Carlos Holguin Mallarino".
