Primero. REVOCAR el fallo proferido por el Juzgado Veinte Penal del Circuito de Medellín. En su lugar TUTELAR los derechos fundamentales a la igualdad, petición y trabajo de Jhon Jairo Ramírez Atehortua.
Segundo. ORDENAR a la Universidad de Antioquia que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente decisión, dé respuesta afirmativa o negativa a la petición ante ella elevada por el señor Jhon Jairo Ramírez Atehortua para el reconocimiento de sus cesantías parciales.
Si la respuesta fuere afirmativa, deberá la Universidad, dentro del término de cinco (5) días a dicha respuesta, cancelar al demandante las cesantías reconocidas, siempre y cuando exista la disponibilidad presupuestal para ello. Si esta no existiere dispondrá de máximo de un (1) mes, término dentro del cual deberá iniciar y terminar las gestiones necesarias para la consecución de los recursos económicos que garanticen el respectivo pago.
Tercero. Por Secretaria, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
