- Primero. REVOCAR la sentencia del Juzgado 23 Penal Municipal de Medellín, dictada en este proceso el 3 de marzo de 1999.
- Segundo. TUTELAR el derecho constitucional fundamental a la salud de la menor Eliana Marcela Zapata Cano y ordenar al Instituto de Seguros Sociales que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, le suministre el medicamento Delifón según la prescripción médica, normalice el tratamiento prequirúrgico a ella recomendado y sin dilación, en cuanto él esté terminado, programe la cirugía a que se ha hecho referencia en este proceso.
- Tercero. NEGAR el suministro de pañales solicitado para la menor, de conformidad con lo expuesto en la parte motiva de esta sentencia.
- Cuarto. LÍBRESE por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
