- Primero. REVOCAR las sentencias proferida por el Tribunal Superior de Ibague el 24 de septiembre de 1999, y la Corte Suprema de Justicia el 17 de noviembre del mismo año y, en su lugar, otorgar la tutela de los derechos al debido proceso, al pago oportuno e integral del salario y al mínimo vital del señor José Alberth Villada Garzón.
- Segundo. ORDENAR al Banco Ganadero, sucursal San Simón de Ibagué que en el término de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, devuelva a José Alberth Villada Garzón el total de las sumas correspondientes a su salario que le retuvo, añadiéndoles la debida indexación.
- Tercero. PREVENIR al Banco Ganadero, sucursal San Simón de Ibagué, para que se abstenga de actuaciones como las que originaron este proceso, so pena de las sanciones previstas en el Decreto 2591 de 1991 para el desacato.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
