- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. de Menores de Neiva y en consecuencia, CONCEDER la tutela del derecho a la salud en conexidad con la vida de la menor KAREN ANDREA FLÓREZ ARDILA.
- Segundo. INAPLICAR, para el caso concreto que fue objeto de análisis por esta Sala, el literal f. del artículo 18 de la Resolución 5261 de 1994, expedida por el Ministerio de Salud por contrariar los artículos 13 y 44 de la Constitución Política.
- Tercero. ORDENAR a la E.P.S. del Instituto de Seguros Sociales que en el término de cuarenta y ocho (48) horas después de notificada esta sentencia, realice las diligencias necesarias para el suministro de la silla de rueda a la menor Karen Andrea Flórez Ardila previa valoración del médico tratante.
- Cuarto. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
