Primero. REVOCAR la sentencia proferida por el Juzgado
Segundo. Penal del Circuito de Cartagena, el once (11) de febrero de mil novecientos noventa y nueve (1999), que confirmó el fallo proferido por el Juzgado
Sexto. Penal Municipal de Cartagena el cinco (5) de enero de la misma anualidad. En su lugar CONCEDER la tutela de los derechos fundamentales a la vida, la dignidad y el trabajo de la señora Yadira del Carmen Benitez Gómez.
Segundo. ORDENAR al Gerente del Hospital Universitario de Cartagena que, si todavía no lo ha hecho, proceda dentro de un término máximo de cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, a pagar los salarios a la señora Yadira del Carmen Benitez Gómez, siempre y cuando exista la debida partida presupuestal. Si no existiere o fuere insuficiente, dispondrá del mismo término ya señalado para iniciar las gestiones tendientes a obtener los recursos necesarios para el pago efectivo y completo de lo ya ordenado.
Tercero. PREVENIR al Gerente del Hospital Universitario de Cartagena, para que evite volver a incurrir en las omisiones ilegítimas que originaron esta tutela, so pena de las sanciones legalmente establecidas.
Cuarto. LÍBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
