- PRIMERO. REVOCAR la sentencia proferida por el Juez
- Primero. Laboral del Circuito de Bucaramanga al fallar sobre la acción de tutela instaurada por los señores Liberto Rodríguez Rodríguez, Héctor Jaimes Correa y Orlando Mateus Romero contra la Nación -Ministerio de Educación Nacional-
- SEGUNDO. Ordenar al Ministerio de Educación Nacional y al Departamento Administrativo del Servicio Civil, que en un término razonable, que en todo caso no podrá exceder de treinta (30) días calendario, contados a partir de la fecha de notificación de esta providencia, reubiquen a los indicados ciudadanos en cargos de igual o superior categoría a los que venían ejerciendo en el Instituto Colombiano de Construcciones Escolares -ICCE-.
- TERCERO. Líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991 para los fines allí contemplados.
- CUARTO. Los jueces de tutela deberán resolver aquellos casos cuyas características fundamentales coincidan con las aquí estudiadas, atendiendo al mandato consagrado en el artículo 23 del Decreto 2067 de 1991.
