- Primero. REVOCAR las sentencias proferidas por las Salas de Casación Laboral y Penal de la Corte Suprema de Justicia del 9 y 17 de marzo 1999. En su lugar, TUTELAR los derechos fundamentales a la vida digna y al pago oportuno de las mesadas pensionales, de las señoras Avelina Barrios Burgos y Edith Elvia del Socorro Castilla Morales.
- Segundo. ORDENAR al Gobernador del Departamento de Bolívar que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, proceda a pagar las mesadas pensionales adeudadas a las accionantes, siempre y cuando exista la partida presupuestal correspondiente. Si esta fuere insuficiente, dispondrá del término ya señalado para iniciar las gestiones tendientes a obtener los recursos necesarios para el pago efectivo y completo de lo ordenado.
- Tercero. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
