- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. REVOCAR por las razones expuestas, el fallo proferido por el Juzgado Civil Municipal de Guateque el 30 mayo de 1994, en relación con la acción de tutela instaurada por los jóvenes NOLBERTO SOSSA RAMIREZ y JAVIER ANTONIO CALDERON VACCA.
- SEGUNDO. PREVENIR a la Empresa Electrificadora de Boyacá, a efectos de que no vuelva a incurrir en conductas como las aquí descritas, de suspensión del servicio de energía eléctrica cuando está de por medio el derecho fundamental a la educación, y COMUNICAR al Ministerio de Educación Nacional, para que adopte a la mayor brevedad, las medidas pertinentes encaminadas a la atención y pago del servicio público de energía eléctrica del Colegio Nacionalizado Enrique Olaya Herrera del Municipio de Guateque (Boyacá).
- TERCERO. Por Secretaría, líbrense los oficios de que trata el artículo 36 del Decreto 2591 de 1991.
