- Primero. REVOCAR, por las razones expuestas, la Sentencia dictada el 21 de abril de 1995 por el Juzgado
- Noveno. de Familia de Santa Fe de Bogotá, que denegó de manera absoluta la protección solicitada.
- Segundo. CONCEDESE la tutela de los derechos fundamentales que, por la conducta de mutua agresión entre sus padres, han sido vulnerados a las menores hijas de JOSE BENITO INFANTE QUEVEDO y ANA BEATRIZ ORJUELA RODRIGUEZ.
- Tercero. En consecuencia, el Comando de Policía de Kennedy Estación 8 ejercerá vigilancia permanente y cercana sobre la pareja de compañeros permanentes en mención, con el objeto de impedir que continúen los actos de violencia señalados en la demanda.
- Cuarto. ORDENASE a los compañeros permanentes JOSE BENITO INFANTE QUEVEDO y ANA BEATRIZ ORJUELA RODRIGUEZ abstenerse en el futuro de ejecutar actos de violencia física o moral entre sí o respecto de sus menores hijas.
- El incumplimiento de esta obligación dará lugar, por cada vez que en él incurran, a las sanciones previstas en el artículo 52 del Decreto 2591 de 1991, impuestas por el Juez de primera instancia en este proceso.
- Quinto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
