- PRIMERO. REVOCAR por las razones expuestas en la parte motiva de esta providencia, la sentencia proferida por el Juzgado
- Cuarto. Civil Municipal de Santa Marta el 11 de mayo de 1995, y en su lugar DENEGAR la tutela limpetrada.
- SEGUNDO. ORDENAR al Juzgado
- Cuarto. Civil Municipal de Santa Marta que compulse copias del expediente a la Procuraduria General de la Nacion, a fin de que, si lo considera pertinente, inicie la investigacion a que haya lugar, en relacion con el incumplimiento del efecto inmediato de la sentencia de dicho Juzgado, de fecha 11 de mayo de 1995, asi como de las diligencias judiciales correspondientes de que trata la parte motiva de la presente sentencia.
- TERCERO. LIBRENSE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
