- Primero. Por las razones que anteceden, CONFIRMANSE las sentencias proferidas en el asunto de la referencia por el Juzgado Trece Penal del Circuito y por la Sala Penal del Tribunal Superior del Distrito Judicial de Barranquilla, con las siguientes precisiones:
- a) SE NIEGA la tutela impetrada en cuanto a la solicitud de exclusión del servicio militar y el desacuartelamiento de CRISTIAN ALBERTO LLANOS GUZMAN, por cuanto su situación no encaja en ninguna de las causales de exención previstas en el artículo 28 de la Ley 48 de 1993.
- b) SE NIEGA la tutela impetrada en cuanto a la suspensión de toda intervención quirúrgica del conscripto.
- c) Para prevenir eventuales daños o perturbaciones en la salud e integridad personal de CRISTIAN ALBERTO LLANOS GUZMAN, se ordena al Comandante de la Segunda Brigada A.S.P.C.2 del Ejército Nacional impartir instrucciones precisas a los superiores militares de CRISTIAN ALBERTO LLANOS GUZMAN para que se abstengan de obligarlo a la práctica de actividades y ejercicios contraindicados para su actual estado de salud, mientras éste permanezca, según dictamen médico de la propia Institución.
- Segundo. El Juez de primera instancia vigilará el estricto cumplimiento de lo ordenado en esta providencia.
- Tercero. Notifíquese según lo previsto en el artículo 36 del Decreto 2591 de 1991.
