- PRIMERO. REVOCAR la sentencia proferida por el Juzgado once Penal del Circuito de Santafé de Bogotá, D.C., del catorce (14) de abril de mil novecientos noventa y tres (1993), conforme a la parte motiva de esta providencia. En su lugar, TUTELAR el derecho a la intimidad y al buen nombre de Elizabeth Céspedes de Villarraga y Gustavo Villarraga Gutiérrez en contra de la firma de INVERSIONES M.C.
- SEGUNDO. PREVENIR a la firma INVERSIONES M.C. para que, bajo el apremio de la sanción legal en lo sucesivo se ABSTENGA de observar conductas que atenten contra los derechos fundamentales de Elizabeth Céspedes de Villarraga y Gustavo Villarraga Gutiérrez en el cobro del crédito a que se ha hecho referencia.
- TERCERO. COMUNIQUESE la presente decisión al Juzgado Once Penal del Circuito de Santafé de Bogotá, D.C., para que se notifique a las partes conforme lo dispone el artículo 36 del Decreto 2591 de 1991.
