- PRIMERO. REVOCAR la sentencia del Juzgado 16 Laboral del Circuito de Bogotá del 4 de diciembre de 2003 y, en consecuencia, CONCEDER la tutela al derecho de petición de Luis Gabriel Riveros Iriarte.
- SEGUNDO. ORDENAR a la Gobernación de Cundinamarca, Unidad Administrativa Especial de Pensiones, que, de no haberlo hecho, dé respuesta a la solicitud presentada el 21 de julio de 2003 por Luis Gabriel Rivero Iriarte, en el término tres (3) días, contados a partir de la notificación de la presente sentencia.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
