Primero. REVOCAR el fallo adoptado por el Juzgado Dieciocho Civil Municipal de Santiago de Cali el 23 de agosto de 2001, mediante el cual resolvió no tutelar los derechos fundamentales invocados. En su lugar, SE CONCEDE la tutela, como mecanismo transitorio, de los derechos fundamentales a la igualdad, a la rehabilitación e integración social para los disminuidos físicos, sensoriales y psíquicos, a la seguridad social y a la salud a SOL MIREYA MONDRAGÓN RESTREPO.
Segundo. ORDENAR a la Jefe del Departamento de Atención al Pensionado, del Instituto de Seguro Social, Seccional Valle del Cauca, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación personal del presente fallo, incluya de nuevo en la nómina de beneficiarios de la pensión de sobrevivientes a SOL MIREYA MONDRAGÓN RESTREPO, y que siga pagando la prestación hasta que se determine si la mencionada tiene derecho o no a la pensión de sobreviviente por invalidez. Dentro del mismo término, la señorita MONDRAGÓN RESTREPO deberá ser incluida como beneficiaria directa de la prestación de los servicios de salud a que tiene derecho.
Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
