- Primero. CONFIRMAR PARCIALMENTE las sentencias proferidas por el Juzgado
- Primero. Penal Municipal y el Juzgado
- Tercero. Penal del Circuito de Pereira, dentro de la acción de tutela instaurada por la señora María Esperanza Gil Grajales en cuanto negaron la protección constitucional del derecho de petición.
- Segundo. REVOCAR en lo demás las sentencias mencionadas anteriormente y en su lugar CONCEDER la tutela al derecho a la Salud en conexidad con la vida y la integridad personal de la Señora María Esperanza Gil Grajales.
- Tercero. ORDENAR al representante legal del Instituto Municipal de Salud de Pereira y a la Alcaldesa del Municipio de Pereira, dentro del ámbito de sus competencias, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, proceda a afiliar a la Señora María Esperanza Gil Grajales encuestada mediante ficha No. 49.632 en el Régimen Subsidiado de Salud, con observancia de los parámetros legales y reglamentarios que regulan la materia. Dentro del mismo término se deberá expedir el correspondiente carné de afiliación a efectos de que la accionante pueda gozar de la atención integral en salud que requiere para el tratamiento de la patología que padece.
- Cuarto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
