Primero. CONFIRMAR la sentencia proferida por el Juzgado
Segundo. Civil del Circuito de Garzon, Huila del 18 de diciembre de 1997, en cuanto denego el derecho de peticion, y REVOCAR en cuanto a los derechos fundamentales a la salud, vida y medio ambiente sano, todo con base en las consideraciones expuestas en esta sentencia.
Segundo. Sin embargo, es procedente INSTAR al Jefe de la Corporacion Regional del Alto Magdalena Centro Operativo Subregional Garzon del Centro Sub-Regional del Alto Magdalena de Garzon CAM, senor Jose Antonio Rojas Cerquera para que en el termino de un (1) mes contado a partir de la notificacion de la presente sentencia, proceda a verificar que las ordenes impartidas por el, al senor Jose Ignacio Avendano Sanchez en el oficio COG-609 del 26 de septiembre de 1997, el cual le fue comunicado hasta el dia 1deg de octubre del mismo ano, se hayan cumplido plenamente. Si las adecuaciones senaladas no se cumplieren en el termino senalado, dicha autoridad ambiental, debera proceder a imponer las sanciones que al efecto se contemplen en las normas ambientales.
Tercero. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
